1. Service Description

Welcome to elsworth, a platform operated by elsworth. Our website, accessible at elsworth.site, provides users with a range of services related to the elsworth. These services include, but are not limited to, information dissemination, event management, and community engagement tools. By accessing or using our services, you agree to comply with and be bound by these Terms of Service.

These Terms govern your access to and use of our services, including any content, functionality, and services offered on or through elsworth. If you do not agree to these Terms, you must not access or use our services. We reserve the right to modify these Terms at any time, and your continued use of the services following any changes constitutes your acceptance of the new Terms.

Our services are intended for users located in the Czech Republic and are governed by Czech law. If you are accessing our services from outside the Czech Republic, you do so at your own risk and are responsible for compliance with local laws.

2. User Accounts

To access certain features of our services, you may be required to create a user account. When creating an account, you agree to provide accurate, current, and complete information about yourself as prompted by the registration form. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to notify elsworth immediately of any unauthorized use of your account or any other breach of security. elsworth will not be liable for any loss or damage arising from your failure to comply with this obligation. We reserve the right to suspend or terminate your account at our discretion, without notice, if we suspect any violation of these Terms.

By creating an account, you consent to receive electronic communications from us. These communications may include notices about your account and information concerning or related to our services. You agree that any notices, agreements, disclosures, or other communications that we send to you electronically will satisfy any legal communication requirements.

3. Acceptable Use Policy

By using our services, you agree to comply with all applicable laws and regulations and to use the services only for lawful purposes. You agree not to use the services in a manner that could damage, disable, overburden, or impair the services or interfere with any other party's use of the services.

We reserve the right to investigate and take appropriate legal action against anyone who, in our sole discretion, violates this Acceptable Use Policy, including without limitation, removing the offending content from the services, suspending or terminating the account of such violators, and reporting such violations to law enforcement authorities.

5. Content Ownership

All content, features, and functionality on elsworth, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, and software, are the exclusive property of elsworth or its licensors and are protected by Czech and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the services for personal, non-commercial purposes. This license does not include any resale or commercial use of the services or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of the services or its contents; or any use of data mining, robots, or similar data gathering and extraction tools.

Any unauthorized use terminates the permission or license granted by elsworth. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our services, except as follows: your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.

6. User-Generated Content

Users may have the opportunity to submit, post, or otherwise contribute content to the services ("User-Generated Content"). By submitting User-Generated Content, you grant elsworth a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.

You represent and warrant that you own or control all rights to the User-Generated Content you submit and that the content is accurate, not confidential, and not in violation of any contractual restrictions or other third-party rights. elsworth takes no responsibility and assumes no liability for any User-Generated Content submitted by you or any third party.

We reserve the right to remove or edit any User-Generated Content for any reason, including but not limited to, violations of these Terms, or if we believe that such content is objectionable or infringes on any party's intellectual property rights.

7. Payment Terms

Some services offered on elsworth may require payment. By using these services, you agree to pay all applicable fees and charges associated with your use of the services. All payments must be made in Czech Koruna (CZK) unless otherwise specified.

Payment processing will be handled by a third-party payment processor. By providing your payment information, you authorize elsworth to charge your payment method for the total amount due. You are responsible for ensuring that your payment information is accurate and up to date.

All fees are non-refundable unless otherwise stated. If you fail to make any payment when due, we may suspend or terminate your access to the services until payment is received. We reserve the right to change our fees and payment terms at any time, provided that we will notify you of any changes prior to their effective date.

8. Service Modifications

elsworth reserves the right to modify or discontinue, temporarily or permanently, the services (or any part thereof) with or without notice. You agree that elsworth will not be liable to you or to any third party for any modification, suspension, or discontinuance of the services.

We may also impose limits on certain features and services or restrict your access to parts or all of the services without notice or liability. Any new features that augment or enhance the current services shall also be subject to these Terms.

It is your responsibility to review these Terms periodically for changes. Your continued use of the services after any modifications to the Terms will constitute your acceptance of the modified Terms.

9. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall elsworth, its affiliates, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of, or inability to access or use, the services; (ii) any conduct or content of any third party on the services; (iii) any content obtained from the services; and (iv) unauthorized access, use, or alteration of your transmissions or content.

In no event shall elsworth’s total liability to you for all damages, losses, and causes of action exceed the amount paid by you, if any, for accessing the services. This limitation of liability shall apply whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if elsworth has been advised of the possibility of such damage
